By downloading, installing, or using HyperPDF, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the application. These terms form a legally binding agreement between you and HyperPDF.
✅ Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the HyperPDF mobile application ("App"), website at hyperpdf.cloud, and any related services (collectively, the "Service") provided by HyperPDF ("we", "us", or "our").
By accessing or using the Service, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
📱 License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install one copy of the App on iOS devices that you own or control
- Use the App for your personal, non-commercial purposes
- Access and use the Service as made available to you
This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or Service. All rights not expressly granted are reserved by HyperPDF.
The App is licensed to you through the Apple App Store, and your use is also subject to Apple's Licensed Application End User License Agreement.
✔️ Permitted Use
You may use HyperPDF to:
Edit & Annotate
Add annotations, drawings, text, and signatures to your own PDF documents.
Secure Documents
Encrypt, password-protect, and compress your personal files.
Share & Export
Export annotated PDFs and share them with others via any iOS share sheet.
Manage Files
Organize, rename, and archive your PDF library within the app.
🚫 Prohibited Uses
You must not use HyperPDF to:
Infringe Copyright
Reproduce, distribute, or modify copyrighted documents without authorization.
Circumvent Protection
Bypass, reverse-engineer, or tamper with any security or encryption features.
Automated Abuse
Use bots, scripts, or automated means to access or scrape the Service.
Illegal Activity
Create, distribute, or possess documents that violate applicable laws.
You also may not: (a) decompile, disassemble, or reverse engineer the App; (b) remove or alter any proprietary notices; (c) use the App to develop a competing product or service; (d) impersonate any person or entity; or (e) interfere with the proper functioning of the Service.
Fraudulent Documents: Using HyperPDF to create, alter, or sign fraudulent, misleading, or forged documents is strictly prohibited and may constitute a criminal offense. HyperPDF bears no liability for misuse of signature or annotation features.
©️ Intellectual Property
The App, including all software, design, graphics, text, and other content (excluding your own documents), is owned by HyperPDF and protected by copyright, trademark, and other intellectual property laws.
The "HyperPDF" name and logo are trademarks of HyperPDF. You may not use our trademarks without prior written permission.
Feedback
If you submit feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a royalty-free, worldwide, irrevocable license to use, modify, and incorporate that Feedback into our products without any obligation to you.
📂 Your Content
You retain full ownership of all PDF documents and content you create, import, or annotate using HyperPDF ("Your Content").
By using the App, you represent and warrant that:
- You own or have the necessary rights and permissions to use Your Content
- Your Content does not infringe the intellectual property rights of any third party
- Your Content does not violate any applicable law or regulation
- You are solely responsible for the legality, accuracy, and appropriateness of Your Content
Since HyperPDF processes all documents on-device, we do not access, view, or store Your Content on any server. You are responsible for maintaining backups of your documents.
🔗 Third-Party Services
The App integrates with third-party services including Google Firebase (analytics and crash reporting) and optionally the OpenAI API (for AI-powered features). Your use of these services is subject to their respective terms and privacy policies.
HyperPDF is distributed exclusively through the Apple App Store. Your purchase, if any, is subject to Apple's App Store Terms of Service. Apple is not responsible for the App or these Terms.
We are not responsible for the availability, accuracy, or content of any third-party services and we do not endorse any third-party services linked from within the App.
⚠️ Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure at all times
- Any defects or errors will be corrected
- The App will be compatible with all devices or iOS versions
- Annotations or exports will render identically in all third-party PDF viewers
Use of the App is at your own risk. You are solely responsible for any damage to your device or loss of data that results from use of the App.
⚖️ Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HYPERPDF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, documents, or annotations
- Loss of profits or business opportunities
- Device damage or malfunction
- Unauthorized access to your files
- Any other damages arising from your use or inability to use the App
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $10, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.
🛑 Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms.
You may terminate these Terms at any time by deleting the App from your device. Termination does not affect any rights or obligations that arose prior to termination.
Upon termination, the license granted to you under these Terms immediately ceases. Sections on Intellectual Property, Disclaimer, Limitation of Liability, and Governing Law survive termination.
🌐 Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles.
Any dispute arising out of or in connection with these Terms or your use of the App shall first be addressed through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the competent courts of the jurisdiction in which HyperPDF operates.
You agree to resolve disputes individually and waive any right to participate in a class-action lawsuit or class-wide arbitration.
🔄 Changes to Terms
We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you through an in-app notice or push notification (if enabled).
Your continued use of the App after updated Terms are posted constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the App.
